Dear Mr. Nathaniel Blake,
 

Thanks for your e-mails of 1 and 15 may 2007. Dr. Adisa has referred them to us in the Economic, Social and Cultural Council (ECOSOCC) Secretariat for clarification and direction.

 


While the ECOSOCC Secretariat acknowledges your spirited efforts and commitment to the success of both the Diaspora Initiative of the African Union and the ECOSOCC, we wish to observe that it is important to ensure that this spirited effort is channelled appropriately and in conformity with the processes and procedures approved by the African Union since ECOSOCC is one of its organs.

 


It is therefore our understanding that the process that you have initiated for selection of representatives into the ECOSOCC General Assembly does not appear to confirm with AU procedures contained in the ECOSOCC Statute. Thus, it is our firm belief that class=Apple-style-spanthe path chose by you would not produce legally accredited representatives that could legitimately make claims to seats in the Interim General Assembly.

 


Our position here is based on the ECOSOCC Statute, to which you have so generously referred. class=Apple-style-spanWe would kindly request that you reflect on the provisions of this Statute in its entirely, specially the following specific areas:

 


a)      Under the Transitional Provisions (Article 4), it is provided that “the Interim Standing Committee (ISC) shall ensure that elections for membership of ECOSOCC are finalized as soon as possible so that the General Assembly can be launched within a period of not more than tow (2) yearsâ€?. You would recall that at the last meeting of the AU Executive Council in Addis Ababa in January 2007, the mandate of the ISC was extended till December 2007. This in effect, means that the ISC’s mandate over the conduct of elections was also extended. It is imperative to note that the ISC in its meeting in Cairo in February 2007, decided to defer the election of Diaspora representatives (See attachment). This decision is yet to be rescinded or reviewed.

 


b)      Significantly also, we wish to draw your attention to the Articles 6 and 12, which deal with the eligibility criteria for membership of ECOSOCC and the Credential Committee. It is obvious from the provisions of Article 12 that the responsibility for ascertaining and approving the qualifications of candidates is vested in the Credentials Committee. It is therefore a condition precedent that the Credentials Committee shall, before any elections are conducted into ECOSOCC General Assembly, must verify and shortlist applicants.
We do not think it is tenable for any process to produce Diaspora delegates when the African Union has not specified the number of representation for each region. We therefore wonder how one can assign three delegates or such to the US when the issue of global distribution is yet to be settled?

 


It would also be important to stress that the Diaspora programme is not an ECOSOCC programme. It simply feeds into ECOSOCC. Thus, arrangements for selection of Diaspora representatives would require close coordination with the African Citizens Directorate of  the Bureau of the Chairperson, which oversees the Diaspora programme. We would request that you get in touch with the Diaspora Officer in view of your commitment to the programme for further clarification and elaboration. You may also visit the CIDO website: [url=javascript:ol('http://www.africa-union.org/cido.htm');]http://www.africa-union.org/cido.htm[/url], for additional information on the process. Fortunately, the ECOSOCC Secretariat is currently also in CIDO and this facilitates close coordination and interaction between the Interim organ and CIDO.

 


class=Apple-style-spanWe would therefore urge you to proceed with caution and restraint as there are broader issues and concerns governing Diaspora representation in ECOSOCC that are yet to be resolved. The commitment of the AU Commission is to ensure that the principle of Diaspora representation in AU organs, processes and institutions is extended in a cumulative and progressive fashion so that ultimately, even the Pan-African Parliament and the Commission would have Diaspora members. class=Apple-style-spanTo succeed in this mission, it is essential that we all proceed in a manner that is consistent with appropriate rules and regulations and in the spirit of African renaissance.

 


There are other aspects of your letter that you may wish to pursue further with the line managers of the Diaspora programme. class=Apple-style-spanHowever, as members of the Commission, we know that the AU has not designated any group as official representative of the Western portions of the AU/Diaspora connection. While we welcome the enthusiasm and support of all groups and organisations that have devoted time, energy and resources to the Diaspora programme, such as your organisation, class=Apple-style-spanit is important that we respect the integrity of our Pan-African commitment. However, the current direction of the Commission is to support the establishment of regional Diaspora networks in the various regions, which will then support the participation of the Diaspora in AU organs, forums and institutions.

 


Furthermore, we wish to acknowledge your contribution on sensitising the African Diaspora community in the US about AU programmes and policies but will advice that this should be closely coordinated with AU official instruments – the Washington Office and CIDO in the AU Commission, to ensure that we can construct a solid architecture of efforts that will allow the total sum to be greater that its parts.

 


Finally, we wish to associate the ECOSOCC Secretariat with the previous communication of the Washington Office in this regard. Please accept our apology for the slight delay in response.
