I’m gonna admit I didn’t read all the posts, just the first few as it seemed to get heated quickly and I wanted my last post be a positive one.

All I wanted to say is thank you.

No judgment on whether you did the right or wrong thing, used the correct rules or wrong procedures, in fact to be honest I don’t give a damn as their rules and regulations were never designed to help us.

I just respect the fact you did something. There’s a saying that roughly goes… it takes good people to do nothing for evil to triumph.

If you ever get into a situation like this again don’t forget that we at Ligali have no problem exposing the company publicly and writing to the directors and leaving your name out of it. frenchconnectionuk all that confidentiality nonsense. Just make sure you’ve got your back covered and they cant find out you sent it to us ok.

The facts are if you're going to teach..then teach correctly with the right advice, in the right way used in the correct context.. It is obvious that you didn't read the scenario properly or else you would know there cannot possibly be a claim against the employer..

The fact is an employee sent the offence email, without the knowledge or consent of her employer.. The author did not give the employer an opportunity to act or to put in action their policy before retaliating twice..

This is NOT the US, where you can make frivilous just because someone looks at you the wrong way, in the Uk you actually have to that stupid thing called evidence and a basis on which to make a claim.. my point is there clearly isn't one.. But you know different then I'd be very interested to know..

Lastly if you had been so quick to skim this thread, you would have read me give advice on how she could have acted in a way that might have been more effective...but why let the small matter of facts get in the way of you making a cheap hollow point..

Thanks for all the supportive comments I've received.  I recently had an appraisal and at the end of it I thought I would take the opp. to ask my line manager if she felt I was wrong to respond to the offensive email in the way I did.

Her reply:  No I think you were justifiably offended HOWEVER the girl who sent the email did have a point because she did warn that some people may find it offensive, so you didn't have to open it. 

As you can all see, even though this girl's actions clearly breached company policy (which I pointed out to my managers and the girl, so ignorance is no excuse) I was still put in the wrong.  Also, notice I was not put in the wrong for attempting to sort out my grievance in the incorrect way; possibly because my employers were not interested in hearing any complaint from me regardless of how I chose to bring it to their attention.

My manager also told me that she felt the tone of my email was 'aggressive' and the follow up email was 'argumentative'.

Here is the exact email I first sent which has been described as 'aggressive'.

"I found this email really offensive and not at all funny.  I know people sometimes send round 'bad taste' emails after such disasters/tragedies...but I would rather not receive any.


 


Thanks all."


 


Here is my follow-up email described as 'argumentative':


 



"Regardless of whether or not people open them, sending offensive email is actually classed as gross misconduct in the staff handbook.  Quite serious really!  I know you're leaving soon anyway but if you receive any more emails like that I would suggest you just forward them to people who you know for a fact will not be offended. 


 


I'm sorry if you feel I'm lacking a sense of humour and making a big deal out of nothing but I honestly find images of human beings suffering really sickening and not at all amusing."


 

I think that a lot of people (esp. white) automatically think 'argumentative' and 'aggressive' as soon as they see a black woman and I think that my manager's opinion of the emails I sent are actually her opinions of me possibly backed up by my colleague's opinions.  I did reply to my boss that I was annoyed at the email I received and my annoyance may have come across in the emails, but it seems annoyance and aggression are interchangeable for this woman.  I am the first to admit that I can and do display aggression when necessary and will argue my point when I feel it is necessary but I can honestly say I have never felt the need to be either argumentative or aggressive since working here towards any of my colleagues (except on one occasion toward one temp who overstepped the mark!) primarily because I have very little contact with them therefore little opportunity to get aggressive or to argue with them.  Some of you may find this difficult to accept (Kunjufu) and may believe that I must be what my manager says/thinks I am, but as you can see for yourself, different people have different ideas about what constitutes 'aggressive' and 'argumentative'. 

I honestly have no reason to come here and lie about my relationships with my colleagues and pretend I am all sweetness and light when I know I am cussing and fighting with them every day - so I was astonished to find that I am perceived in this way and I am under no illusion that the main reason I am perceived to be 'aggressive' and 'argumentative' is because of the colour of my skin.  I should have asked my boss to present with me with one colleague who I have ever argued with or been aggressive towards - but I guess if I did that I would have been proving her point, lol.
