The AA completely messed up my car and now won’t pay compensation for their incompetence.
A few weeks ago on my way to work, I heard a strange noise coming from the engine.  So when I got to work I called out the AA, the man came and checked the car and told me it was fine, nothing wrong with it and that I could drive it home.
One day later my car engine was completely gone, so I called out the AA again, The 2nd AA man, then confirmed that I had absolutely no oil in the car and that as a result my engine is complete f**ked. Now please bare in mind that the 1AA man said that he checked the oil.
(My car had also been serviced 4 weeks earlier).
So I wrote a letter to the complaints and claims dept. After weeks of chasing them for a decision, I got a letter this morning telling me that they are not accepting responsibility and will not be fixing my car or pay compensation,
I have since bought a new car, which I had not planned on doing for another year or two, this cost was not budgeted for at this time.
The fact remains that if the 1st AA man had spotted the problem I would have my car today.  This was even confirmed by 2nd AA man that came out.
I have two questions: Has anyone been in this type if situation? And if you have how did you deal with it?  Also am I being unreasonable for asking the AA to take some responsibility for the situation?

I honestly don’t know if it is worth taking this case further by contacting a solicitor or should I just cut my losses???confused3

Please help!!!!!

only a woman could run a car dry of oil...

just write a threatening letter threatening to take them to court....if they keep rrecord they will see that the 1st man failed to see the problem...realise they havent got a leg to stand on and pay up.

good luck

:D How did I know that someone would come up with the "woman thing". LOL

I will have you know that I had my car serviced about 4/5 weeks prior to this.

I am not one of these women that looks under the hood of a car, BUT I did get it serviced and the oil was checked then.
:?

Anyway thanks for the advice.

Miss Nellia....you're not going to like this...but I don't think you have a claim against the AA.... However even if you pursue the AA you would have to prove he said what he said and that he checked your car...to be honest it comes down to his word against yours and I do see how without a witness or some other form of evidence you're going to prove a thing...btw i really can't see that his collegue who came out second will stand against him, do you?

My view is that you would have a better claim against the jokers who serviced your car... provided that you could get a report that clearly stated that your car was damaged by the lack oil, and that you can then prove that you had the it serviced and that an oil change was supposed to be part of it... You might with such evidence be able to make a case in the small claims... getting solicitors involved isn't going to be cost effective i'm affraid unless you're talking a spanking new car..but even then you will have to fine the money and be sure of your case...

Hmmm you might have eat this one...

@Kunjufu
I can't beleive that I am going to have to let this one go.... you're right, it is his word against mine.  I have the receipt from the servicing company it does say that the oil was checked. I'll write them the same letter I wrote to the AA and see what happens.

Does this mean that I have to totally scrap the car???? Will I get anything for it?  What about a reconditioned engine? Are they any good or advisable?
So annoyed.

Thanks for your advice anyway K.

Exactly, I won't give up just yet, but it is frustrating. I think I'll end up scrapping the car.

You need to be careful and indeed have a case. You might end up losing money again - which I don''t think you want to .

I also agree that if you had service the car 4 weeks ago, the engine shouldn't have dried up, you need to check with those guys.

Hmm, getting your money back from these companies is not easy, if you have a case, you could try watchdog or so, I sold a car not too long ago, I got conned by some idiots who are a company and saw my advert on autotraders, but they promised to match a buyer within 1 week or else they give me a free holiday etc. I paid £85 to get the car advertised with them, I was skeptical, but the holiday made me fall for it, I paid them and I didn't get a single caller

What about the holiday, this people gave me some rubbish places , besides.... I have to paid 90% of the cost, plus I have to bring a friend along who would also pay and the food they serve in the hotel would cost me £50 per night whether I eat or not

I tried to get my money back after a week, but it was too late. there was nothing I could do

@ Hurricane

Thanks for your response, I have been told by a number of people that I have a case, but like you and Kunjufu said it will probably end up costing me more that it is worth to pursue.  So my options are to totally scrap that car, or try one more time.

I will check out the people that serviced my car on Tuesday, as Monday is a bank holiday and see what happens.

As for your case, it is disgusting the lengths people will go to get a sale, then palm you off with some inferior offers that turn out to be just as big a rip off.  I hope you did not accept the holiday.

I find that when a woman turns up, or should I say, when I show up these people automatically see girly girl and then rip me off.  So I try to do these things with my brother or BF in tow, but not everytime are they available to accompany me so I have to deal with these people on own.

I phoned a few salvage yards today and none of them want to make me an offer for the car, they will come and pick it up for free, but that's it.

geeese I give up.:(

Wow I think that your best bet is Watchdog. Also go bakc to the gargage because the car shouldn't have dried up in that time as someone said previously. Either the AA guys are lying or the garage guys are at fault for something.

If the car has been serviced then 1. shouldn't have been dry on oil  2. The oil warned light should have come on 3. It's not usual for a car to completly mash up in four weeks because of no oil.

What car was it?

How many miles had it done?

Sounds real suss. If you had a full service they should have completly renewed the oil. A car doesn't just fail because of no oil, the fact that it had no oil will contribute to other thingd like overheating or blown head gasket etc.

The car is a 2 door rover 200 sdi, and it has 77,000 on the clock I think.

I think I have decided to scrap the car, because I was just talking to a lawyer friend of a friend and he advised me of my case, he says I have a case that a solicitor waould take, but that the costs would be high and should I lose would incur even more charges.

I agree with you, the oil was checked at the last service, so I know it was alright, and that I was not driving around on empty, plus as you say the oil light would have come on.

Your not the first person to mention watchdog.  Food for thought.

Thanks for you response though Kam.niceone.gif

Funny that, because the 2nd AA man said that he really gets called out for Rovers.  They are meant to be very reliable.  Oh well they were dead wrong... what about the Ford Focus 5dr,hatchbacks, do you know if they are any good? because I bought one and I think it is starting to play up already. Not my year for cars I think.:?

I bought it from car giant in White City, it has a full service history, it had a 114 points inspections and is in pretty good condition.  I love it, its black and suits me down ot the ground.:D. The mileage is abit high 55,000 it's 3years old.
I was driving along yesterday that engine light came on, so I checked the manual and it said that it is an engine problem and to take it to the dealers asap.  So I'm gonna take it to Fords tomorrow.:X

Miss Nellia,

I agree with Kunjufu in that your claim should be against those who serviced your car. However, these people tend to tie you up in knots and may not be worthwhile, but try anyway.

I have a Ford Focus 1.4cl. I've had it for 3 years and I've had no problems with it, apart from it doesn't like going uphill too much! That said, it's a good little runner and starts everytime. Another bonus is cheap parts and servicing. I get mine serviced and MOT'ed at the same time, and it's never cost me more than £100.

Just remembered, this happened to me last year and apparently it is a common problem. The speedo cuts out then comes back again? The battery will drain and it will cut out on you on a motorway, as it did me last year!

Did you take it to a main dealer? If so it'll cost you a fortune to fix! Hubby took it to a friend of his who charged £300, so the main dealer will charge the earth.

I can't remember exactly what the problem was, but I know it wasn't the alternater, and Hubby can't remember either. The battery was changed though as whatever it was totally drained it.

Thanks Kam Kam you sure do know how to make a girl feel good!!!:D
I took noone with me because ....well brother was in New York, and BF was being a ***** that day and refused to come with me, so I went on my own.  I knew the mileage was high but the guy said that the car was in top condition.   blktears

O well!!! You've depressed me now:D

I know, I've written to the service company and made a complaint, so fingers crossed!!!!

Don't you just love the ford focus', they are so nifty.  I took it to the garage and they 'put it on the computer' as they say, and nothing came up apart from reset the code (whatever that means).  So I only paid £45.... or should I say Car Giant paid £45, and were brill btw, despite what Kam Kam said.

Thanks for response Lady Vee

You're welcome Miss Nellia, and welcome to the club!

Hubby remembered what the problem with my car was - I was wrong, it was the alternator. Anyway, all fixed now! Glad it was a minor problem, but watch out for what I said. It's prevalent on Focuses, apparently.

You wait until you park it in a big car park, like Lakeside, then try to find it! My one's silver, so you can imagine the confusion!!

bighairlolbighairlolbighairlol Have you noticed that every other car on the seems to be a Ford Focus???  I never realised just how many are on the roads...
Good little runners though. My three choices were Red, Silver or Black.  Ended up with black....
